Art Gallery Sales Terms & Conditions
Welcome to Sharkey Gallery where we showcase and sell fine works of art by Kevin Sharkey. By purchasing or selling artwork through our gallery, you agree to abide by the following terms and conditions. Please read them carefully before proceeding.
- Artwork Sales: All artworks presented for sale at Sharkey Gallery are curated and represented by the gallery. The gallery retains the right to accept or decline the sale of any work based on our selection process, artist agreements, and other relevant factors.
- Pricing and Payments: The prices for all artworks listed in the gallery are set by the artist. All prices are in euros and include applicable taxes unless stated otherwise.
Payment for artwork must be made in full before the transfer of ownership takes place, unless otherwise agreed. We accept payments through Bank transfer, credit card or cash, and any payment-related issues or disputes must be resolved promptly. - Deposits: A nonrefundable deposit may be required for artworks purchased through the gallery, particularly for commissioned works or pieces held for a customer. This deposit is applied to the total purchase price of the artwork. In the event of a cancellation, the deposit is not refundable under any circumstances.
- Cancellations & Returns: All sales are final. We do not accept returns or refunds for artwork once the sale is completed. In the event of a custom or commissioned piece, no cancellations are allowed once the project has been confirmed, and any deposit paid is nonrefundable.
- Shipping and Delivery: Shipping fees for purchased artworks are not included in the purchase price unless specified otherwise. The buyer is responsible for shipping costs, and these will be calculated and added to the total cost of the artwork at the time of purchase.
The gallery will ensure that the artwork is properly packed and shipped, but the buyer is responsible for any, shipping, customs fees, import taxes, or other charges that may arise during transit. - Ownership and Transfer: Ownership of the artwork will not transfer to the buyer until full payment has been received and cleared. Upon receipt of full payment, the buyer will receive a certificate of authenticity (if applicable) and all other necessary documentation to confirm their ownership of the piece.
- Condition of Artwork: The gallery makes every effort to accurately represent the condition of artworks in its care. However, slight variations in colour, texture, or presentation may occur due to lighting, photography, or individual perceptions. If you have concerns about the condition of a particular piece, please contact the gallery prior to purchase.
- Liability: Sharkey Gallery is not responsible for any loss, damage, or theft of artwork after it has been delivered to the buyer. We take great care in ensuring artworks are safely handled and shipped, but once the artwork is in the buyer’s possession, the responsibility for its care and security is transferred to them.
- Artist’s Rights: All artworks are the intellectual property of the artist and are protected by copyright law. Buyers may not reproduce or alter the artwork in any way without the express permission of the artist or the gallery.
- Privacy: All customer information, including contact details and payment history, will be kept confidential. This information will only be used to process the sale, and for communication regarding orders, unless you have opted in to receive further information from the gallery.
- Changes to Terms: Sharkey Gallery reserves the right to update or modify these terms and conditions at any time. Any significant changes will be communicated to customers prior to affecting future sales, and continued engagement with the gallery will constitute your acceptance of the updated terms.
By purchasing artwork from Sharkey Gallery, you acknowledge that you have read, understood, and agreed to these terms and conditions.
